Jolliness Is the First Casualty in the War Between the Elves

The Mad Elf is squaring off against the Rude Elf and that jolly holiday-time spirit is sure to become the first casualty in this battle. Troegs Brewing Co. has asked the U.S. Patent and Trademark Office to cancel Bethlehem-based Fegley’s Brew Works trademark on Rude Elf Reserve, because it’s too similar to its highly sought after seasonal sipper Mad Elf, the AP reports. That likeness they charge could confuse consumers and muddy their branding image. The Fegley folks, who changed the name of their holiday beer eight years ago following another trademark suit, are firing back, saying that Troegs wants to “monopolize the word elf,” and that they have no intentions of renaming their beer again. The discovery phase of the legal action began yesterday and is expected to run through the rest of the year. Exactly which brewery has been naughty and which one has been nice, remains to be seen.
